Hold on to Your Squirt Guns: There's Trouble in Paradise

Behold the evil squirt gun -- according to island legend, it holds strange evil powers that no child shall touch.

Consider this pending legislation in Hawaii:

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 709, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
“§709- Sale of toy guns to minors prohibited. (1) It shall be unlawful to sell, attempt to sell, or offer for sale a toy gun to a minor under eighteen years of age; provided that it shall be an affirmative defense to any prosecution that the:
(a) Purchaser falsely represented the purchaser‘s age by producing a driver’s license bearing a photograph of the licensee, a state identification card, or similar card purporting to be a valid identification card indicating that the purchaser was eighteen years of age or older;
(b) Appearance of the purchaser was such that an ordinary prudent person would believe the purchaser to be eighteen years of age or older; and
(c) Sale was made in good faith relying upon the indicators of age in paragraphs (a) and (b).
(2) Any person who violates this section shall be subject to a fine of not more than $2,000, imprisonment of not more than ninety days, or both.”
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

So it’s come to this, the elite Nanny State is making its application of political correctness such an exercise in pure behavioral fascism, they seek to outlaw toys guns subjecting those who violate the law to fines of $2,000 or up to 90 days (as in THREE months) in jail. For starters, do not Hawaiian Police, Prosecutors, and Courts have better things to do with their time?
Attempting to get to the underlying psychology of this nonsense is fascinating. Are they so frustrated that they cannot get to the real deal, real guns for adults because of a dirty little thing called the 2nd amendment? Their obsession with guns as being some kind of evil fetish is extreme neurosis at best and seems at least intellectually psychotic.
Isn’t it funny that violent youths was not perceived as a major social problems when toy guns including cap guns were staples in every little boy’s toy chest. Of course these days why do kids need toy guns when they can wipe out entire planets or even galaxies in video games.

As it stands right now, this measure is only a proposal, but that something so totally absurd could even surface in the halls of the Hawaiian legislature is insane enough. That elected officials have such casual indifference to setting meaningful priorities for their agenda and would even spend one moment of time on such nonsense shows ideological extremism and gross incompetence.
Let’s hope that our tropical paradise state is fully aware of the insanity that grips their legislature and that this insanity will be tossed out to the obscurity it deserves. Voters should take note of any and all officials supporting this measure and respond accordingly when the next election is held. This kind of absurd nonsense, Nanny state extremism, insane intrusion into private affairs, and total contempt for limited government and individual liberty, couldn’t be more obvious and must be countered with full force.

Does the 2nd Amendment Protect Assholes?

Colorado radio station owner and personality pushes the limits on gun rights.

Brett Reese is not a conservative. He’s an asshole, but how far does an asshole half to go before it would be inappropriate for him to legally carry a gun?

Reese is a talk show flame thrower who broadcasts on radio station KELS-FM in Greely Colorado where he is also a member of the Greeley-Evans school board in Weld County. He threatened a “shootout” with a rival radio station’s owner if he didn’t stop calling businesses that underwrite Reese’s non-commercial radio station.

One would normally assume that he was talking figuratively albeit it irresponsibly and his comments were not to be taken literally. Nevertheless, he further helped stake his reputation as a mad man in many peoples’ views for his editorializing against Martin Luther King Day as a national observance calling King among other things, “a degenerate embezzler,” “a plastic god,” and “an American-hating communist.”

No doubt many on the left would consider such remarks “hate speech.” This writer would considerate his remarks ill-motivated lies and mischaracterizations. He walks a fine line between outright lies and grossly unpopular and unacceptable opinions.

Do these factors render him unworthy to carry a gun with a permit? It certainly makes his presence on the school board questionable unless he was elected to serve and that community desires a hater like him on their board.

The question is does being an asshole who expresses ridiculous opinions justify grounds not to carry a gun?

He claims he has received numerous death threats for airing his unpopular views. Surely, right minded people would challenge his assumptions in the snap of a finger. He goes on to defend himself by saying, "That's not what my push is. I think it's important for people to discuss any issue openly, freely and without being assassinated or bankrupted."

The cost of free speech, however, is that once one says something inflammatory, it becomes that person’s obligation to deal with the consequences his free speech brings. The same freedoms Brett Reese is exploiting in a hateful, hurtful manner are the same freedoms Dr. Martin Luther King exploited to enlighten a whole society to the wickedness of promises unfulfilled, of a population of Americans denied what most of the population took for granted on account of their skin color and origin.

King was a human being. He is not above criticism. An honest biography conducting a complete appraisal of his life would show some of his political positions were quite extreme. While it is constructive and noble to honor his great accomplishments, it would be equally wrong to deify him putting him above critical evaluation.

It is also unfortunate how many opportunists attempt to invoke King’s legacy and cloak themselves in King’s reputation attempting to say that their positions are an outgrowth of King’s vision. Some as radical as members of the New Black Panthers to paranoid nut jobs like Glenn Beck have attempted to do just that. Imagine that, Glenn Beck attempts to convince his audience of fawning bobble heads that he’s saying exactly what Martin Luther King might have said. If the angry little man had truly revered Dr. King, there’s no way in hell he would have held his rally of self justification held last August 28th on the 47th anniversary of King’s great “I Have a Dream” speech.

Supporting Brett Reese in any context is very tough to stomach. Perhaps his very presence on public airwaves could be contrary to his FCC license. While authorities should assume nothing, it is probably most appropriate that he be subject to a hot interview or hearing to determine his worthiness to carry a concealed weapon. Certainly, those responsible for issuing permits should be very clear what he means by “shootout.”

As much as it would be wonderful to argue otherwise, his way out of bounds remarks about Dr. Martin Luther King are protected by the 1st Amendment and unless his comments unlawfully insight violence, that’s no reason to deny him the rights the 2nd Amendment promise.

Brett Reese, one way or another, YOU have a lot of explaining to do.

Tucson Shootings -- Fallout

Who wouldn't have known that the knee jerk liberal reaction to the horrors that beset Tuscon, Arizona would be more justification for more gun laws.  As the NRA folks have long said, outlaw guns and then only outlaws will have guns.  Here's the latest attempt, rest assured there will be more in the days ahead and the rhetoric will be worse.

Short of an all out ban on certain kinds of weapons or even all as some radicals would prefer totally contrary to the 2nd amendment no matter how much they chose to spin it, there are tons of gun laws on the books. In cities where handguns have all but been outlawed, the black market runs wild.

We do need to find ways to do better background checks to screen out the mentally deranged but for fear of invading their civil rights, that could be very thorny to accomplish. Look at all the things that broke down in the horrible tragedy that beset Virginia Tech just a couple years ago.

The solution is effective enforcement of current laws and that those who use guns in the commission of crimes are shown no mercy. While kids rot in jail for drug possession, how many dangerous criminals have been released too soon or have plea bargained their way out of justice?

American Mayors Agree: "We got all them guns goin' 'round killin' people!"



450 mayors representing a national coalition petitioned President Barack Obama to embrace numerous actions on restricting gun use. The mayors, a supposedly by partisan coalition, identify themselves as “Mayors Against Illegal Guns.” Anytime citizens see an effort like this, law-abiding citizens who have respect for constitutional law must immediately be concerned especially given the mentality so prevalent among the self-styled progressives that guns kill people, not recognizing people kill people, and putting the focus keenly focused on those who do the killing.

Nothing clarified this issue better than when WJZ-TV, Channel 13, in Baltimore was doing a story on gun violence decades ago when a reporter asked a female citizen her reaction to the murders in her neighborhood. She responded, “Well, ..we’ve got all these guns going around killin’ people!”

Yeah right. Then we should also be fearful of all those automobiles going around killing people as hundreds of citizens are killed each year in auto accidents.

Some of their recommendations are sound involving information sharing between Federal resources and interstate communication reporting the activities of illegal gun trade, but they also focus on gun-shows which could be stepping on lawful gun owner’s toes, and while gun show purchases are shown as a loophole, there simply isn’t evidence that gun shows are the source of guns used in the commission of violent crimes.

What most politicians fail to comprehend and thus have their efforts way off target is that most criminals get their guns on the black market. Some never have ever passed through the American retail market at all. Where the most severe limits on gun sales or outright bans on hand guns sales have been imposed, the results have never been favorable on curbing gun violence in those communities.

The focus must be on the criminals themselves. They must be apprehended, prosecuted, and processed. When society considers how much law enforcement has on its plate dealing with lesser priorities and just how dangerous and out of control the most violent neighborhoods in cities like Baltimore, Detroit, Washington, DC and Chicago are, it’s easy to see what a difficult task this presents.

Few cities have the spotlight shining brightly on its trouble more now than Barack Obama’s Chicago where urban violence is surging. One of the most brutal crimes in the past week involved an honor student coming home from school walking into gang violence territory. Attempting to render assistance to a wounded victim, the young man was beaten to death with a railroad tie. Yes a railroad tie! The violent criminals and gang-bangers will use any device available to inflict death and mayhem on others.

Cutting off the supply of guns to criminals and breaking the back of illegal gun trade is a high priority for law enforcement, but it’s important that all efforts be correctly focused on the sources of the problem and not to allow the focus to become too broad or to leap into territory where law enforcement does not belong as clearly spelled out in the 2nd amendment to The Constitution.

When one of the President’s closest associates, Cass Sunstein, the head of the White House Office of Information and Regulatory Affairs openly argues that hunting should be outlawed and animals should be able to have their rights represented by lawyers, what kind of sane climate exists for the rational discussion of urban gun violence? Some of Obama’s own remarks make his credentials all the more disturbing whether it was the comments he made on the campaign about citizens who “cling to guns and religion” or his attempts to throw fuel on the racial profiling issue commenting that the Cambridge police “acted stupidly” referring to the arrest of his Harvard crony for his outrageous behavior directed toward a well-qualified and respected officer investing a legitimate concern. Out of this environment any reasonable discussion of the issue seems improbable. Likewise, we must be very fearful of what attitude toward the 2nd amendment potential Obama judicial appointees might have.

Gun violence is one horrible symptom of a segment of society that is totally out of control. Gun violence is almost exclusively the product of poor urban neighborhoods whose population is African-American or in some communities, Hispanic. Most of the participants are from single parent families where gang members have never had a true father figure in their upbringing. They have been unreachable by public school programs that simply fail to attempt to embrace children while they’re still impressionable, set realistic expectations, and nurture them to be successful. Every institution that has some impact on the lives of kids who become violent killers blames everyone else in sight seldom taking responsibility for how their failures adds fuel to the problem.

From a young man’s earliest encounter with society in pre-K schooling, core values, respect for law, and personal responsibility must be stressed firmly and activities must be appropriate to give these kids the opportunity to succeed and master skills that will give them good options in their young adult life – jobs, college, the military, or public service. From day one in school, the lesson must be clear, bad behavior has consequences and achievement is rewarded.

More effort needs to be dedicated to working with the kinds of kids who might become gangbangers before they run astray because we know the consequences of what happens the way things are going now.

That more young African American males of college age are likely to be ensnared in the criminal justice process: in jail, standing trial, on probation or parole than attend post-secondary educational programs not only indicts the failure of their educational upbringing but clearly shows how dysfunctional every aspect of our institutions are in giving this population good, rewarding options.

Society’s response seems to be lock ‘em up and forget them and look for false sources to blame the problem like guns.

With mandatory sentencing and so many citizens jailed for such things as drug possession, we see a justice system that is not corrective and accomplishes little of positive impact. Sure, the real violent offenders should be locked up, but how many young black men are three time losers facing long jail terms for holding some weed or engaging in very low level drug transactions.

Legalizing marijuana alone might do more to curb gun violence than more and more effort to regulate gun sales for that act alone would help break the back of the drug trade.

Our social institutions must work to destroy the reasons that lead people into the world of violence. It starts with the schools and branches out from there.

Somehow this latest plea for action on guns seems like another futile effort that will have no impact on the problem.

Guilty Mostly Stupid -- Issues Arise from Plaxico Burress Two Year Sentence


Maybe not the sharpest knife in the drawer, but.....


Defending Plaxico Burress is not easy. Carrying a concealed loaded gun into a New York nightclub is not only incredibly stupid but dangerous. The danger played out as Burress accidentally discharged the weapon shooting himself in the leg. There’s no way he should have been carrying the gun. If he were entitled to a conceal and carry permit, that would be a different matter, but the bottom line is, if Burress felt he was going somewhere as a frontline NFL player where he needed a loaded gun for protection, that’s a place he should never have gone in the first place. Size it up; guilty for carrying a loaded gun in New York City, an area with some of the harshest gun laws in the country, stupid for doing the same, stupid for going to the nightclub, stupid for how he initially handled the situation.

From the instant the story hit the news, Plaxico Burress was toast. He was immediately suspended from the New York Giants. All the people in a position of power in New York started yapping including Mayor Michael Blumberg who demanded Burress get prosecuted to the max. Those big shot football players cannot be above the law on those tough cops’ beat, right? Make an example out of him. Make him pay. That might also be stupid.

Plaxico Burress pleaded guilty for his crime and now the sentence has been handed down, two years in prison. He could have received three and a half years minimum in the slammer but plea bargained down to two years. Smart or stupid – hard to say, but no trial no report to file as Dirty Harry would say.

NFL Commissioner Roger Goodell needn’t do anything since he has already suspended Burress for the offense. His fate as a possible football player will be addressed after he completes his sentence. Roger Goodell – smart!!!

Sizing this whole thing up, the guy shot himself in the leg. It’s essentially a self-punishing crime. Sure as a veteran NFL player, he’s used to being banged around and knows pain, but a gunshot wound is a special kind of trauma. What purpose does additional punishment serve other than allowing prosecutors and politicians using it for some chest pounding self-promotion? That’s stupid. Does anyone think Burress hasn’t learned his lesson? If he hasn’t he’s incredibly stupid.

There are places in the country where what he did wasn’t illegal at all. In some cities, gun laws are incredibly harsh but do those gun laws make Baltimore, Detroit, Washington, DC, and other cities where urban violence kills on almost a nightly basis. All agree guns should be taken out of the hands of known criminals. That’s smart. Persecuting regular citizens for their second amendment rights is absolutely stupid.

Still, people see things in stupid, simple, black and white terms. As one average Baltimorean responded when a local television reporter stuffed a microphone in her face, “Well, we gotta do something. We got all these guns going around killing people!”

What? Did you get that? Guns are going around killing people??? Now that’s really stupid. When has a gun killed anybody? The real evil and stupidity rests in the hearts of wicked people who use guns as a tools to inflict death and suffering on their intended victims.

So who learns a lesson from the Plaxico Burress sentencing other than stead-fast NRA advocates who legitimately assert that the application of gun laws is arbitrary and overblown.

Be smart not stupid. The real enemy in gun violence is wicked, murderous people not a tool used to commit their crimes. Failing to recognize this and prosecute accordingly is stupid too.

The government is essentially helpless in solving the evil in peoples’ hearts and minds that drive them to murder. Government run schools have all but banished any teaching of real moral values where a Florida Principal and Athletic Director face about as much time in the slammer as Burress for having the audacity of leading a prayer, saying grace over a meal for an assembled group of athletic boosters. No one was forcing kids in the classroom to pray. These gentlemen could also lose their pensions. That’s incredibly stupid as is removing the Ten Commandments and any attempts to allow frank discussions of values and God in the classroom which can surely be done without Congress making laws that impose religion or the free expression thereof. Screwing with the first amendment is as wrong as screwing with the second amendment, and it’s people with the same political values who support both. They’re stupid.

For everyday citizens to speak up and assert themselves and to work together to make their neighborhoods safe, that’s smart.

Sadly, most of the politicians who are part of the majority party and many Republicans too see the state as solution to all and using a football player as a pawn for their political assertions is just plain stupid.
