College Student Fined $675K for Downloading and Filesharing Music Files

How Can Anybody Justify This?

The record industry is at it again obtaining huge judgments for hundreds of thousands of dollars against individuals guilty of downloading and sharing copywritten commercial music. See the following article for a truly outrageous recent case..

How on earth does a punishment this severe fit the crime? If a person were to break into a music store, assault the clerk, steal inventory, or resell the CD’s or give them away, the suspect might do a little jail time, but the fines wouldn’t come close to more than 2/3’s of a million dollars.

Accepting the premise that downloading music is stealing, how much in sales is this young man’s downloading music really costing the record company and its artists? Could we assume that such a person if not having the illegal option to download music and let friends copy it would have purchased the music in the first place or that his friends who he shared music with would have purchased?

It is outrageous that a college student, even acknowledging his guilt, would face such an extreme penalty over what amounts to little more than what would appear to be petty theft.

The big four record companies are the ultimate examples of sleazy corporations that have somehow managed to amass tremendous political influence not just in the United States but elsewhere in Europe and the Pacific rim. The RIAA (Record Industry Association of America) functions as their Gestapo looking for prosecution targets and lobbying the legislature to do its bidding.

We are not in any way suggesting that music piracy is okay. Certainly download operations that provided for massive free exchange of recorded material amounted to a tremendous loss of sales as savvy computer users could use sites like Napster, Kazaa, and other “file sharing” sites provided a massive network where users would basically open their music library for downloading to others while being granted access to other users also enlisted in the program. In the early part of the decade, music consumers had a huge inventory of pirated regular music releases and countless “bootlegs” providing alternative, unreleased, and live recordings not available on the retail market.

Quickly, legislation and legal action attempted to shut down those enterprises, but it is still not difficult for broadband users to figure out ways to transmit tremendous amounts of music files to other users.

The big crime, in our judgment, would be those who set up means by which multiple users can download music possibly allowing for dozens, hundreds, thousands, or more copies of songs to be downloaded to users who would “steal” such music.

However, what of the issue of friends swapping music with friends, a couple of albums, here and there which the other person probably would not purchase in the first place? What about the creative music collector who makes “party” discs for friends highlighting songs from many artists from his or her collection? While this would still be illegal, how should such “crimes” be prosecuted?

One thing’s for certain, absolute financial ruination in the hundreds of thousands of dollars is way out of line.

The music industry should be putting more effort into luring in customers rather than treating every customer as a potential criminal. Creating attractive commercial websites that make it easy to download music for a small fee should cover most situations with the promise of being able to deliver the highest quality sound where the buddy system might provide a compressed jpeg file of 128mbps or less.

Perhaps services should explore the possibility of providing users with open licenses allowing them to download up to a certain number of songs as part of a subscription agreement.

The sad truth is the music industry has not embraced new technologies as they have arisen seeking to punish those who are able to operate ahead of the curve rather than working smarter and staying a step ahead of them.

The whole possibility of downloaded music from the Internet caught the industry completely off guard. Likewise, they were not prepared for the personal music players like iPods or even enhanced cell phones and BlackBerry’s which can be used to listen to music.

Only once Apple computers developed the iTunes network that legally sold tunes for download and offered the attractive iPod making taking tunes on the road so easy, the industry slowly began to wake up.

Meanwhile, the industry’s answer was to develop the next generation of CD’s that would afford better sound quality and allow for 5:1 surround sound capacity as a bonus. Part of the new disc technology would be creating encrypted music files almost impossible to copy. Thus in the late 1990’s the DVDa’s and SACD’s were introduced to market. While there is no denying their sound when properly reengineered is stunning when played over quality hi-fi equipment, because they are encrypted, they are not compatible with digital music players. The SACD Hybrids, which include a backwards compatible regular CD program, allows for conventional “red book” downloads.

Sadly, when it came to the next generation of recorded sound, the music industry threw a party and nobody showed up. SACD’s proved to be a miserable commercial failure even though the early Rolling Stones catalog, Bob Dylan’s greatest classics, significant work by Elton John, David Bowie, among others hit the market to a big ho-hum. The ABKCO Stones albums and classic Dylan albums are now available only as nicely remastered regular CD’s and most labels have all but discontinued SACD sales in the United States. What’s still available is mostly on small labels dedicated to jazz and classical mostly from overseas.

Truthfully, while SACD’s do provide beautiful sound, the limitation of conventional CD’s has less to do with the limits of a 16 bit source which have been manipulated up to 24 bits through various recording techniques, the real problem with CD’s is the horrible lack of quality control in the CD’s brought to the market in the first place.

The record companies in their rush to saturate the market with CD’s costing $15 to $20 initially rather than around six bucks for an LP or cassette, would grab any old master, many of which were EQ’ed for cassettes and forced onto a digital master without looking for the best source or doing any pre-engineering to ensure good sound quality.

Now, many albums are in their second or third generation of remastering, and many CD’s that were horrible when first released are absolutely beautiful now. Further, the jewel case is limiting enough for album information and art work, but so many original CD’s would at best give some image of the album cover and the song listings, all liner notes and other info lost. New releases are doing more to restore original art, liner notes, and often providing new material as well.

While we digress somewhat from the topic of the vicious, heavy handed means the record industry attempts to protect its intellectual property, we illustrate their failings in the entire history of digital music to show that when it comes down to the real basic issues, the music industry is their own worst enemy.

Over 80% of recorded music is released by Universal Music Group, Sony/BMG, Warner Music, and EMI. Their lock on creativity and innovation is a death grip. On the fringes, Rounder, Concord, and Sugar Hill do their best to provide quality music, some pop, but lots of jazz, blues, folk, acoustic, and Americana.

We will continue to follow the failings of the music industry and look at some exciting possibilities that might render the record industry as we know them obsolete in the not too distant future.

When the industry dies, it won’t be because young illegal recorded music entrepreneurs distributed downloaded music illegally. The cause of death will clearly be an industry-wide suicide.

The Crazies Who Live Among Us


There is an intellectual scum that grows in our culture enriched by Hollywood scripts and inflammatory bloggers, media personalities, and even academic elites, the conspiracy theorists.

Whether it’s a myriad of explanations refuting the Warren Commission findings, the notion that somehow the United States government staged the attacks of 9/11/01, or that the Apollo moon landings were faked, there is always a significant number of total idiots from all walks of life who believe such nonsense. Going back into the 1950’s, adding fluoride to drinking water was supposed to be a government plot to sterilize the American population. Surely as far back as the 1860’s, we could probably find theories on Lincoln’s assassination too.

Unfortunately, as American citizens, we enjoy the implied absolute right to be profoundly stupid, but the conspiracy mindset stoked by radio talk show hosts, and movie directors like Oliver Stone and Michael Moore, never ceases to demand way too much attention. How many Oliver Stone movies do not involve some kind of far-fetched conspiracy as a key compenent to the plot? Nevertheless, his works almost take on the tone of being documentaries. In the case of Michael Moore, his approach is to never let the truth stand in the way of fabricating false images of his political adversaries for the sake of advancing his agenda.

The one thing we can give credit to the paranoid sickos who believe this nonsense. There is certain wisdom to mistrust the government and conventional wisdom, but all three of the big ones: the Kennedy assassination, the Apollo landings, and the 9-11 attacks require a special degree of ignorance and paranoia to believe. First is the assumption that behind all of the various theories that counter the truth regarding these events is that somehow our government could have staged such massive cover ups and could have maintained their deception to pull such things off. To the extent the government keeps anything secret for long is highly problematic. Witness the ease to which the New York Times has been able to leak crucial national security secrets.

While there will always be a lunatic fringe, some striking surveys make this more than just something that’s way out there among the real nutcases who walk among us. For starters, about one third of the population doubts the official accounts of the 9/11 terror attacks. Other surveys show that about one in four individuals between the ages of 18 and 25 believe the moon landings never happened. Given that the last Apollo mission to the moon’s surface occurred in 1972, think of at what age a person would be too young to remember the moon landings especially considering that the later missions failed to gather the high degree of media hoopla that Apollo 11 to 14 gathered.

The psyche of the conspiracy believer is intriguing. First, the person is subject to undeniable ignorance believing a tremendous lie to be true. Second there are certain attitudinal components, a sense of false intellectual and moral superiority, that this small person has special insights into the truth that all the rest of us simply cannot grasp that we are the fools not them. Beyond that is a certain degree of paranoia that all kinds of forces around them: the government, media, historians, the public at large and the actual participants closest to the subject all conspire together to be able to pull off something as fantastic as being able to fake moon landings or that our government on some level would kill thousands of Americans toward some ideological aim.

While the consequences of silencing such fools is far more dangerous than letting their idiotic ideas out in the mainstream are far more dangerous, the media is guilty of giving these total jerks way too much of an elevated platform to spew their nonsense. Such pronouncements should be dealt with as would other extremists’ beliefs. This isn’t a matter of “we report, you decide.” This is more a matter of if such nonsense is worthy of being reported in the first place, how much scorn and ridicule should be assigned to such fruitcakes and clearly demonstrating entertaining such nonsense can only come from people who have serious character flaws and psychological disorders. Conspiracy thinking is truly pathological and should be reported as such.

How dangerous is it? Consider the case of Holocaust deniers, strident racists who argue the death of over six million Jews in Nazi death camps never happened. In its most extreme application, Mahmoud Ahmadinejad, the Islamic-Fascist dictator and murderer of his own people in Iran, uses such big lies to justify the annihilation of Israel and death to the Jewish people.

Can we speculate that all conspiracy theories at their core embrace a certain kind of intellectual fascism?

For a person to appoint himself the self-perceived guardian of the truth contrary to the collective knowledge of educated people and the clearly established, observable and documentable truth exceeds being misguided. There truly is a fundamental sickness and evil at play.

It’s time to treat these lowly jerks as the cancer on the pursuit of knowledge and truth they truly are.

Our Two Cents on "Jon & Kate Plus Eight"



If a right-thinking person needs clear evidence our culture is heading to an all-time low, we present Jon & Kate Plus 8 as the smoking gun.

How sick can the audience be? Are we just a culture of voyeurs?

The program is yet another example of exploitation reality television following the day-to-day lives of a contentious couple, Jon and Kate Gosselin, headed toward “Splitsville” with eight children’s lives in the balance who are awkwardly hoarded into being part of the show. Could this be a child labor law abuse?

Regardless, sleazeballs, commercial or private, should be accountable and pay for their behavior. They're raking in enough ad revenue on this fiasco.

It’s carrier is the TLC network. TLC!!! Wasn’t that supposed to be “The Learning Channel?” Exactly what is the lesson to be learned here?

If this is supposed to be “reality,” what does one make of all the posturing for the cameras?

This genre of television way over the line of common decency, but it will surely be outdone when Nadja Suleman, the hated Octomom gets her time on the tube in the near future.

This leaves right-minded people thinking what is worse, that a television network would devise just below-the-belt programming or that there is a huge audience that can’t get enough of this garbage?

Shame on all of them.

American Idol Sucks!!!


For the record, I don’t give a rat’s ass who wins "American Idol."I don’t know which one is the homosexual and which one is the Christian and could care less. Surely, coming to a music department near you will be Adam Lambert and Kris Allen CD’s. You can bet on that while Simon Cowell laughs his smart ass all the way to the bank.

One columnist said it well, “Isn’t the stuff on ‘American Idol’ the exact reason rock n roll was created in the first place?”

What has "American Idol" contributed to the wealth of pop music? Nothing! Okay, Carrie Underwood is generic chart topping country music. Ho-hum, they all follow the same formula. We’ll put Sara Evans above them all. Ah, but the real country stars are ones like Emmylou Harris and Dolly Parton.

The format drives me nuts. Who needs the freak show in the early episodes just to see how Simon rips the contestants to shreds and how they pout and burn in return?

“American Idol” perpetuates bland, highly commercialized pop music. Who needs more of that? In today’s world with three mega-international corporations and a floundering EMI controlling about 80% of all recorded music and such a huge chunk of radio owned and operated by CBS/Viacom and Clear Channel, fresh, creative music is the casualty.

I don’t think I’m getting old. I think music from the 1990’s forward is just plain uninspired garbage or poor knockoffs of better stuff from the past. I was 16 years old in 1969, the whole music scene was exploding in all genres; however, the worst of the worst was some of the most awful music too.

All forces in the industry and the entertainment media are stacked against there ever being a new pop sensation the scope of the Beatles or an era of unbelievable creativity as we witnessed in the 60’s and early 70’s.

Meanwhile, I just placed the order today, the beginning of my 4th refresh of the Rolling Stones albums from the beginning of Rolling Stones Records in 1971, “Sticky Fingers,” “Goats Head Soup,” “It’s Only Rock N Roll,” and “Black and Blue.” The 1974 Virgin records refresh did miracles over the original CBS/Sony release of these albums on CD. They are pretty darned good and at least rival the quality of the European releases on vinyl, but with the promise of hearing more clearly defined instruments and a fuller sound, this fan can’t get enough. Why the music industry did such a shoddy job of putting CD’s on the market in the first place is the subject of a future posting.

Tonight, I’ll be watching the Orioles get massacred in Yankee stadium or “The O’Reilly Factor.” I’d probably watch two hours of the Sham-Wow guy over “American Idol!”

Cable Industry Unwires Sports Fans


Effective May 1, Comcast subscribers will no longer receive the NFL Network. While this might not be a big deal in May, just wait until the NFL season begins next fall with a regular schedule of Thursday night football games in early November and Saturday night games after the college season is over. This is the same Comcast that does not offer EPSN-U, the ESPN network dedicated to college sports or ESPN-360 that provides a variety of streaming videos some of live sporting events on its broadband Internet service.


Comcast has offered NFL Network as part of a premium add-on service consisting of EPSN News, Classic ESPN, Fox College Sports networks, NBA network and a couple other sports networks. The NFL Network maintains is programing deserves to be shown as part of the cable network's basic service, that the quality of its programming and viewer interest is sufficient that it should be made available to all cable subscribers. The result of this dispute, no NFL network for subscribers including much of the Mid-Atlantic (much of the Baltimore-Washington area and south central Pennsylvania, Philadelphia, Chicago, and also much of California, Michigan and other states. Where competitive services are not available only Direct TV serves as an option, an impractical or prohibited solution where installing an external "dish' is not practical.


Though cable service is primarily an entertainment proposition, cable franchises are granted to serve to public interest by local governments which stipulate certain provisions for proprietary rights to provide service giving them a virtual monopoly in most instances. While some companies have been customer friendly and responsible others have been the personification of corporate arrogance. Time-Warner Cable, for instance, which serves much of central North Carolina refuses to carry MASN (Mid-Atlantic Sports Network) despite MASN carries coverage for many colleges in the region and the area is part of the media territory established for both the Baltimore Orioles and Washington Nationals. This dispute has played out in court for three years.


Given the examples of Comcast taking on football fans and Time-Warner shunning sports fans in central North Carolina, one has to wonder if these industry giants might be letting their short-sighted anti-customer thinking might turn them into the next commercial dinosaur as satellite services like Direct TV offer more options catering to customer interests and competition like Verizon FIOS takes hold. While networks like NFL Network, MASN, and the additional ESPN networks do charge cable operators to provide their programming, cable operators have breaks for local advertising that should easily off-set the costs given the loyalty of sports viewers and the advertisers who target them as customers.


Surely, there is blame to be shared by both Comcast and the NFL who are lying in their public relations statements on the subject; Comcast arguing they're interested in keeping the cost of cable subscriptions down and the NFL arguing that they're looking out for customers who shouldn't have to pay an additional premium to view their programs. We are not interested in supporting winners and losers in these corporate struggles when the real loser is the customer, the dedicated sports fans. The bottom line is Comcast is too greedy to support the millions of football fans stuck with their service.

The Obama campaign is showing its true heart born in the radical associations with the likes of Weatherman founder, William Ayers, an unapologetic domestic terrorist and devote Marxist in how it is responding to informational spots by conservative 527 groups attempting to show the public what we've all been anxious to know, "Who is the REAL Barack Obama?" My heart says, "Methinks he's a communist in polite media friendly sheep's clothing." Yeah, communist sounds so old-fashioned to Gen-X'ers and younger, but WAKE UP!

Many prominent Democrats are anxious to reimpose the Fairness Doctrine which amounts to defacto government censorship of radio and television programming by insisting all political views must be counterbalanced with time for the opposing position. Here's how it gets ugly. First who determines what represents "mainstream" thinking -- as in those issues and positions that are not tilted left or right? If the standard bearers insist that Global Warming is the consequence of human behavior, for instance, only those who oppose global warming politics would be the extreme view needing to be balanced. Since the media is demonstrably liberal, yet they define themselves as the central balanced view, where does that put everyone else?

The liberal bias is demonstrated repeatedly when Republican politicians are quickly singled out as "conservative" while Democratic politicians are not labelled as "liberal." When politicians get in trouble like the Craig affair from Utah, his party affiliation is all over the place. If Democrats do the naughty, hmm, what party does this naughty boy belong to? They just don't want to let the reader know.

Under the scenario given above, liberal values are status quo, thus anyone questioning them are automatically expressing viewpoints that would need to be balanced in the interest of what they call "fairness." Exactly what kind of views would be shown as "left of center." Barack Obama is left of center for sure even if compared to the previously stated positions of Democrats like Hilary Clinton, Joe "Blowhard" Biden, Harry Reid, and well...even Barbara Boxer as Obama has been defined as the most LIBERAL member of the Senate.

How would radio programmers handle having shows like Rush Limbaugh, Bill O'Reilly, Sean Hannity, Dave Preger, Glenn Beck, Laura Ingraham, Mark Levin, Neal Boortz, Hugh Hewitt, G. Gordon Liddy, Laura Schlessinger, Mike Gallagher, Larry Elder, Brian Wilson, and even Baltimore's own Ron Smith deal with the necessity to "balance" these commentator's programming?

Try some Liberal counter programming? Like Air America? The bankrupt Air America? They sure have some tough talkers, don't they -- lefty blabbers: Al Franken, Randi Rhodes, Keith Olbermann....those kind of folks. ARRGHHH!!!!

Radio programmers are in the business of making money, if a station commits to broadcasting as many stations do in the Eastern Time Zone, Rush Limbaugh followed by Sean Hannity, then they need SIX hours of Liberal programming. Kiss the lucrative morning drive slot bye-bye??

The truth is the Liberal movement in this country has no tolerance for dissent, no patience for "diversity" when it comes to varying points of view, and total contempt for the first amendment not just on this issue but others (...the free expression part of Freedom of Religion, gun control, lots more) as well. Television news ABC, CBS, CNN, and NBC range from traditionally liberal to absolutely far left. Only Fox news provides some balance where a wide range of viewpoints are aired and conservatives at least get their time on issues. The weekly news magazines go from traditionally liberal, US News and World Report often a pretty responsible source, to Time (same crew as CNN) to Newsweek which is right on the level of the DailyKOS. The New York Times, Washington Post, Los Angeles Times and Boston Globe set the tone for the extreme liberal bias shown by most major market daily newspapers. Internet headliners like Google, Comcast, Yahoo, Salon, and others are both Leftist and gossipy.

Talk radio is the only information source that the left in this country has not overtaken. Conservative talk show hosts provide entertaining, fast-paced, highly-listenable programming which has become an oasis of sanity for so many Americans looking for a medium that shares their hopes, dreams, fears, and doubts.

Most Conservative talk shows have substantial listener call-in segments where opposing views are expressed, but surely that won't count. Now here's something that probably would. Assume there were such a thing as a "moderate" or "middle-the-road" talk show. What happens when the callers to the station express decidedly conservative viewpoints. To the "fairness guardians" tally how many "conservative" versus "mainstream" callers are given air time? Where does it stop?

Obama can have this issue both ways. Surely, if it comes up for a vote before January, President Bush will veto it. Obama won't be present for the vote -surprise, surprise. Should the unthinkable happen and Obama seizes control of the White House, should a Democrat Senate and House pass the "Fairness Doctrine" would a President Obama veto his own party's legislation on this issue?

This is but one issue that makes the Obama Nation unthinkable, but the far-left's attempt to silence its opponents by any means necessary will continue. God forbid the whole "hate" speech concept gains momemntum. Who would decide what is hate speech and who is guilty. On the surface it seems so contrary to the first amendment but who's going to be able to appoint justices to the agining Supreme Court.
The Supreme Court...another reason to fight aggressively the onslaught of Obama Nation.

During the pregame program for Fox Network's, MLB Baseball, Larry Flynt's Hustler Club was advertised as part of a "Tailgating Update from Pickles Pub." The pitch was to find local girls to audition to become "Hustle Honeys" at the Baltimore Hustler Club, advertised as a "Gentleman's Club" in this spot. While there was nothing more than gals in t-shirts shown in this commercial, the product they're peddling has no place on commercial television particularly on family programing, a Saturday afternoon baseball game, for God's sake!!!

Larry Flynt, of course, is the father of Hustler magazine, a sleazy vile publication that sought magazine space right next to Penthouse and Playboy in local news stands. It wasn't long after Flynt's arrival that such magazines were either put behind the counter or not sold altogether at local convenience stores. Sadly, Flynt has publications far worse than Hustler, as in Barely Legal. It just gets worse from there. Flynt made millions and has used he wealth in many vulgar enterprises including some of his political activity. While we recently took our shots at Steve Francis, founder of Girls Gone Wild, he's a lightweight compared to the world class scumbag, Flynt.

If guys want to support Larry Flynt purchasing his magazine and attending his club, that's their business. Likewise, if young ladies chose to defile themselves and offer themselves up as commodities in the sleaze market, as long as they do so freely and fully understand what's expected of them, that's their business. There's a special ring of hell awaiting Mr. Flynt when mortal days are done. It seems his politics, life-style, and business interests all sync together so masterfully. If the Democrats are the big tent party, the least they could do is shovel up the horse doo-doo and discard of it properly, but Flynt is a huge supporter of lots of their candidates and pet causes.

Advertising vulgar stuff on the public airwaves is OUR business. Why should a father have to answer a question from a kid, "Daddy, what's a gentleman's club?" Young man, you'll find out soon enough, to be sure. WBFF-TV and their sponsor, Pickles Pub, have no business promoting sexploitation during baseball game coverage. What should be more All-American as in Hot Dogs, Apple Pie, and the Girl Next Door than watching a baseball game?

Shame on Channel 45, the Sinclair Broadcast Group, and their management team who would cater to such vulgar instincts among local sports fans. This is the same station that has sold plenty of ad space to Joe Francis for Girls Gone Wild and airs spots every night for kinky phone services as if any of the gals really look like the models in the television spots. David D. Smith, the President and CEO of the Sinclair Group, one of the largest owners and operators of local television stations nationwide headquartered in Cockeysville Maryland, has a long history of shady dealings and bad behavior. Gee, what kind of person would we expect these days to be a big-time media mogul. Would Ruppert Murdock, world-wide media big shot, disapprove of one of his local affiliates hawking a convicted felon and pornographer's product in support of his programing? One would hope so. Channel 45 actually has a pretty decent local news format especially compared to WJZ-TV and WMAR-TV.

If you don't like this situation, why not politely share your thoughts with the folks at WBFF-TV? Let them know this bothers you, affects your viewship, and is something you do share as a concern with others. Keep it sweet, but make your point!
